These Terms of Service govern your access to and use of Fanvy services at fanvy.ai. By creating an account, connecting Fanvue profiles, or using Fanvy features, you agree to these Terms.

1. Acceptance of Terms

You agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced in this document. If you do not agree, do not use Fanvy.

If you use Fanvy on behalf of an agency, company, or another legal person, you represent that you have authority to bind that organization.

2. Description of Service

Fanvy is a CRM and AI chatbot platform designed for Fanvue creators and agencies. We provide unified inbox workflows, automation tools, analytics, and AI-assisted messaging features.

Fanvy may evolve over time. We can add, remove, or modify features as part of normal product development and security operations.

3. Account Registration

To use Fanvy, you must:

Be at least 18 years old
Provide accurate and current registration information
Keep account credentials secure
Promptly notify us of unauthorized account access

You are responsible for all activity under your account, including actions by team members you invite or authorize.

4. Acceptable Use Policy

You agree not to use Fanvy to:

Violate applicable law, regulation, or third-party rights
Send spam, scams, abusive content, or deceptive communications
Distribute malware, attempt unauthorized access, or disrupt systems
Scrape, crawl, or harvest data from Fanvy outside approved interfaces
Reverse engineer or attempt to derive source code from the platform
Bypass security controls, rate limits, or account restrictions

We may investigate suspected abuse and suspend or terminate access where necessary to protect users, infrastructure, and legal compliance.

5. Fanvue Integration

Fanvy integrates with Fanvue APIs through OAuth. Fanvy is an independent service and is not affiliated with, endorsed by, or sponsored by Fanvue.

You are responsible for your compliance with Fanvue's terms, policies, and community standards. If your Fanvue access is limited or revoked, some Fanvy features may become unavailable.

6. AI Features

Fanvy may provide AI-assisted suggestions, drafts, and automations. AI outputs can be inaccurate, incomplete, or contextually inappropriate. You remain fully responsible for reviewing and approving messages before they are sent.

Fanvy does not guarantee specific business outcomes, conversion rates, or engagement improvements from AI features.

7. User Content

You retain ownership of your content and underlying business data. By using Fanvy, you grant us a limited license to host, process, transmit, and display your content solely to operate, secure, and improve the service.

This license ends when your data is deleted under our retention process, except where retention is legally required.

8. Subscription and Payment

Fanvy subscriptions are billed monthly through Plisio (crypto payments). Paid plans renew automatically unless canceled before the next billing date.

Cancellation prevents future renewal but does not reverse prior charges

You are responsible for applicable taxes, duties, and blockchain/network fees charged by third-party payment providers.

9. Refunds

Unless required by law, Fanvy does not provide refunds for partial billing periods or unused subscription time. Exceptional refund requests may be reviewed case by case at our sole discretion. For cryptocurrency payments and cancellation details, see our Refund Policy.

10. Intellectual Property

Fanvy and all related software, design, branding, and documentation are owned by Fanvy or its licensors and protected by applicable intellectual property laws.

No rights are granted except those expressly stated in these Terms. You may not use Fanvy trademarks without prior written permission.

11. Termination

You may stop using Fanvy at any time. We may suspend or terminate accounts for violations of these Terms, security risks, legal requirements, or non-payment.

After termination, account data is generally retained for up to 30 days to allow export/recovery requests, then deleted or anonymized under our retention policy unless legal obligations require longer storage.

12. Disclaimers

Fanvy is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted service, complete security, or error-free operation. Scheduled maintenance, outages, or third-party disruptions may affect availability.

13. Limitation of Liability

To the maximum extent permitted by law, Fanvy's total liability for claims related to the service is limited to the amount you paid to Fanvy in the twelve (12) months before the event giving rise to liability.

Fanvy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption.

14. Indemnification

You agree to defend, indemnify, and hold harmless Fanvy from claims, liabilities, damages, and expenses arising from your use of Fanvy, your content, your integrations, or your violation of these Terms or applicable law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any dispute not resolved informally will be submitted to arbitration in English, unless mandatory law requires another forum.

You and Fanvy agree to attempt good-faith negotiation before initiating formal proceedings.

16. Changes to Terms

We may update these Terms from time to time. Material changes may be communicated through the website, product notices, or email. The latest version always appears on this page with the updated date.

Continued use of Fanvy after changes become effective means you accept the revised Terms.
